Statutory Electronic Contract Notice
This electronic record is generated by an automated computer system and does not require physical or digital signatures. This document is published in full compliance with the provisions of Rule 3 (1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and satisfies the legal validity of electronic contracts under Section 10A of the Information Technology Act, 2000 and the Indian Contract Act, 1872.
1
Parties & Definitional Framework
"Platform" or "Company" refers to QRPrint, its parent entity, affiliates, cloud relays, web services, and registered developers.
"Merchant / Shop Operator" refers to any business entity, xerox center, stationery shop, commercial print bureau, university kiosk, or individual who establishes a merchant tenant account, installs the desktop spooler software, or prints customer orders.
"Walk-in Patron / End-User" refers to any customer who scans a counter QR stand, accesses the touchless print portal via a mobile web browser, or uploads digital documents for physical print output.
"Desktop Spooler Agent" refers to the lightweight, background Windows client software designed to poll platform webhooks and dispatch raw document raster data directly to locally connected print spoolers.
2
Eligibility & Contractual Capacity
By accessing, browsing, registering, or deploying the software, you affirm that you are at least 18 years of age and legally competent to enter into a binding contract under Section 11 of the Indian Contract Act, 1872 (or the applicable age of contractual majority in your legal jurisdiction). If registering on behalf of a partnership firm, commercial business, or corporate body, you declare that you possess the explicit corporate authority to bind that entity to these Terms.
3
License Grant & Software Scope
Subject to timely subscription payment and strict compliance with these terms, the Platform grants the Merchant a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to: (a) access the Cloud Shop Management Dashboard; (b) deploy the Windows Spooler Agent on designated counter workstations; and (c) generate dynamic counter QR stands to facilitate touchless document submission. You shall not reverse-engineer, decompile, disassemble, or tamper with the Spooler binary, API tokens, or webhook protocols.
4
Intermediary Safe Harbor & Content Prohibitions (IT Act 2000)
Under Section 79 of the Information Technology Act, 2000, QRPrint functions strictly as an Intermediary providing automated conduit infrastructure. The Platform does not initiate the transmission, does not select the receiver of the transmission, and does not select or modify the documents contained in the transmission.
In compliance with Rule 3(1)(b) of the Intermediary Guidelines Rules 2021, all users and operators agree NOT to upload, host, display, or print any document that:
- Infringes any patent, trademark, copyright (including pirated academic textbooks), or other proprietary rights under the Copyright Act, 1957;
- Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, or racially/ethnically objectionable;
- Involves counterfeit currency, fake government identification (Aadhaar cards, Voter IDs, Passports, Driving Licenses), forged educational certificates, or judicial stamps;
- Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order;
- Contains software viruses, Trojan horses, rootkits, worm logic, or any destructive computer program designed to interrupt or compromise host computer systems.
5
Document Ownership & Intellectual Property
The walk-in patron retains 100% full, unconditional ownership and copyright over every digital file, PDF, or image uploaded to the service. Neither QRPrint nor the Merchant acquires any intellectual property ownership or publication rights. The Merchant is strictly prohibited under contract and penal law from duplicating, archiving, reading, or disseminating patron files for any purpose other than executing the specific physical print command authorized by the customer.
6
Separation of Financial Transactions
QRPrint provides pure SaaS dispatch infrastructure and does NOT act as a payment gateway, custodial escrow, or financial intermediary for physical printing sales. All end-user printing fees collected via cash, counter UPI, or static merchant QR codes are retained 100% directly by the Merchant without platform commission or deductions. Any billing dispute between a patron and the shop regarding change, page counts, or paper quality is solely between those two parties.
7
Limitation of Liability & Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND CLOUD SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". QRPrint DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE PLATFORM, ITS DIRECTORS, OR DEVELOPERS BE LIABLE FOR MECHANICAL PRINTER HARDWARE DAMAGE, ROLLER JAMS, TONER DEPLETION, FIRE HAZARDS, THIRD-PARTY ISP OUTAGES, OR LOSS OF BUSINESS PROFITS. THE MAXIMUM AGGREGATE LIABILITY OF THE PLATFORM FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES ACTUALLY PAID BY THE OPERATOR TO THE PLATFORM DURING THE ONE (1) MONTH IMMEDIATELY PRECEDING THE CLAIM.
8
Governing Law, Arbitration & Jurisdiction
These Terms shall be governed by and construed in accordance with the substantive laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved by binding arbitration conducted by a sole arbitrator appointed in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be within the capital jurisdiction of the platform's registered headquarters, and courts having territorial jurisdiction shall have exclusive authority over any interim judicial reliefs.
Data Protection & Confidentiality Charter
Privacy & Data Protection Policy
Compliant with DPDPA 2023 • IT Rules 2011
Strict Zero-Harvesting Architecture
Statutory Privacy Framework (DPDPA 2023 Compliance)
This Privacy Policy is framed pursuant to the Digital Personal Data Protection Act, 2023 (DPDPA), Section 43A of the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
1
Zero Document Retention Guarantee
The cornerstone of our architecture is Complete Document Privacy. QRPrint does NOT read, index, OCR, scrape, train AI models on, or permanently store customer documents. Uploaded PDF and image files reside in volatile, encrypted server cache only for the minimal operational duration required to convey raster data to the local Windows spooler daemon, after which they are permanently unlinked and shredded.
2
Categories of Information Collected & Processed
We process only two distinct, transparent categories of data:
A. Merchant Account Data (Persistent)
- Shop business legal name & physical location address;
- Registered operator name, corporate email address & mobile contact;
- Hardware identifiers, desktop agent UUIDs, and printer queue IDs;
- Subscription invoicing records & payment gateway transaction tokens.
B. Ephemeral Order Metadata (Volatile)
- Randomized 12-character alpha-numeric order reference token;
- Job configuration: page count, color choice, duplex selection, copies;
- Masked phone/email (if optionally supplied for SMS pickup alerts);
- Client IP hash and timestamp strictly for DDoS prevention (24h roll-off).
3
Data Fiduciary vs. Data Processor Roles
Under the Digital Personal Data Protection Act, 2023:
• The Merchant / Shop Operator acts as the Data Fiduciary regarding walk-in customers visiting their retail premise.
• QRPrint acts strictly as a Data Processor providing automated transmission, rendering, and spooling technical facilities on behalf of the Data Fiduciary.
4
Transmission Cryptography & Transport Security
All network payloads traversing between the customer's mobile browser, platform cloud relays, and the local shop PC are encrypted using modern Transport Layer Security (TLS 1.3) protocols with 256-bit AES encryption. Access to document download endpoints is restricted via single-use, time-delimited signed URLs authenticated by SHA-256 HMAC tokens that expire automatically within 15 minutes.
5
Patron Rights: Access, Correction & Complete Erasure
Every walk-in customer maintains the right to demand instant confirmation of file shredding. Once a print job completes at the counter, the local spooler agent reports completion, triggering our automated cron to unlink the file immediately. If a customer cancels an upload before printing, the file is unlinked immediately without spooling.
6
Statutory Non-Disclosure & Third-Party Privacy
We never sell, lease, rent, trade, or monetize personal information, metadata, or document data to advertising agencies, data brokers, telemetry aggregators, or unauthorized third parties. Disclosure is strictly confined to mandatory court orders or formal notices issued by law enforcement authorities in compliance with Section 69 of the Information Technology Act, 2000.
B2B SaaS Licensing & Operational Standards
Merchant & Shop Operator Agreement
Commercial Partner Terms • Fair Usage
Multi-Tenant Storefront License
1
Merchant Representations & Business Compliance
The Merchant represents and warrants that: (a) it possesses all necessary municipal shop establishment licenses, GSTIN registrations, and trade certificates required to operate a commercial printing facility; (b) it shall ensure that retail prices configured in the dashboard (per-page rates for B&W, color, and duplex) are transparently disclosed to patrons before dispatch; and (c) all physical print operations are executed in compliance with the Consumer Protection Act, 2019 and local weights and measures regulations.
2
Confidentiality Obligations & Paper Shredding Mandate
The Merchant acknowledges that walk-in patrons entrust highly sensitive, personal, financial, and confidential documents (including taxation forms, legal contracts, medical reports, and photo identity proofs). The Merchant covenants and agrees:
- Never to read, copy, or distribute customer documents beyond the physical print queue execution;
- To immediately physically shred any misprinted, smeared, or paper-jammed sheets containing customer personal data;
- To never hand over an order to any third party who does not possess the matching 12-character order token or verified mobile verification code.
3
Hardware Infrastructure & Local Network Maintenance
The Merchant retains sole operational responsibility for maintaining physical printer hardware, paper trays, OEM ink/toner cartridges, active electrical grounding, and stable broadband internet. QRPrint provides cloud software dispatch and cannot remediate physical mechanical paper tears, printhead clogs, offline USB printer drivers, or local power outages.
4
Account Security & Token Safeguarding
The Merchant is strictly responsible for safeguarding operator credentials, staff sub-account PINs, and Windows desktop agent tokens. The Merchant must immediately notify platform administrators upon detecting any unauthorized access or compromise of host PC credentials.
Financial Transparency & Dispute Redressal
Refund, Cancellation & Dispute Policy
Fair Settlement Policy • 14-Day SaaS Guarantee
Consumer Protection Rules 2020
1
Walk-In Customer Print Orders (On-Site Counter Refunds)
Because walk-in customers pay the shop owner directly via cash or merchant UPI at the retail counter, all customer print disputes and refunds are administered directly on-site by the shop operator in accordance with the Consumer Protection (E-Commerce) Rules, 2020:
- Hardware Faults & Jams: If a printer experiences paper jams, ink streaks, low-toner blank pages, or physical damage, the Merchant shall promptly provide either a complimentary re-print or an immediate 100% cash/UPI refund to the customer.
- Customer Cancelled Orders: If a customer uploads a document but cancels before the shop releases the print command, zero charges shall be levied, and the temporary file is unlinked immediately.
- Operator Pricing Errors: The per-page rate displayed on the customer's phone during QR submission represents the binding price quote. Operators may not demand unauthorized surcharges after job dispatch.
2
SaaS Platform Subscriptions & Merchant Billing
Subscriptions for the QRPrint Cloud SaaS service are billed automatically in advance on a recurring monthly or annual cycle:
- 14-Day Money-Back Trial Guarantee: All newly registered shops are eligible for a 14-day evaluation period. If the platform fails to meet operational requirements, the Merchant may cancel before Day 14 for an unconditional, full refund of paid subscription charges.
- Cancellation Anytime: Merchants may cancel or downgrade plans at any moment directly from the Shop Dashboard. Cancellation takes effect at the expiration of the current paid billing cycle, and no further automatic renewals will occur.
- Pro-Rata Policy: Except for statutory withdrawal periods or verified platform-wide service outages exceeding our SLA, mid-cycle subscription fees are non-refundable once the 14-day evaluation window has elapsed.
3
Chargeback & Payment Gateway Dispute Protocol
In the event of an unauthorized payment or duplicate credit/debit card transaction for SaaS plan renewals, merchants should contact our billing desk at support@qr2print.shop before raising bank chargebacks. Legitimate duplicate billing errors are investigated and resolved within three (3) business banking days.
